1. Acceptance of Terms

By downloading, installing, or using Snag It ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Nicholas Benoit ("Developer," "we," "us," or "our") governing your use of the App.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after any changes constitutes acceptance of the modified Terms.

2. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

3. Description of Service

Snag It is a media downloading application that allows users to save publicly available media content (videos and images) from supported social media platforms including Twitter/X, TikTok, Instagram, Bluesky, and Snapchat.

The App acts as a tool to facilitate downloading and does not host, store, or distribute any third-party content on its servers beyond temporary processing required for downloads. All downloaded content is stored locally on your device.

4. User Responsibilities

You are solely responsible for ensuring that your use of the App complies with all applicable laws, regulations, and third-party rights. By using this App, you agree that:

• You will only download content that you have the legal right to access and save
• You will respect the intellectual property rights of content creators
• You will not use downloaded content for commercial purposes without proper authorization from the content owner
• You will comply with the terms of service of the platforms from which you download content
• You will not use the App for any illegal or unauthorized purpose
• You will not attempt to circumvent any security features or access restrictions

5. Subscription Terms

The App offers optional paid subscription plans ("Premium") that provide additional features such as ad-free experience and access to all supported platforms.

Billing: Subscription fees are charged through your Apple App Store or Google Play Store account. Prices are displayed in the App and may vary by region.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Lifetime Purchase: Lifetime access is a one-time purchase that grants permanent access to Premium features. No recurring charges apply.

6. Intellectual Property

All content downloaded through the App belongs to its respective owners. The App does not claim ownership of any downloaded content.

The App itself, including its design, features, code, and branding, is the intellectual property of Nicholas Benoit and is protected by applicable intellectual property laws.

Users are responsible for ensuring they have appropriate rights or permissions before downloading, using, or redistributing any content.

7. Third-Party Content and Services

The App provides access to content hosted on third-party platforms. We do not control, endorse, or assume responsibility for any third-party content accessed through the App.

The App uses third-party services including RevenueCat for subscription management and Google AdMob for advertising. Your use of these services is subject to their respective terms and privacy policies.

We make no warranties or representations about the accuracy, reliability, completeness, or timeliness of any third-party content or services.

8. Advertising

The free version of the App displays advertisements provided by Google AdMob. By using the free version, you consent to receiving these advertisements.

You may opt out of personalized advertising through your device settings or by upgrading to a Premium subscription, which removes all advertisements.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that downloads will always be successful, as this depends on third-party platform availability.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICHOLAS BENOIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

We are not responsible for any claims, damages, or losses arising from your use of downloaded content or any violation of third-party rights.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Nicholas Benoit, and any affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you download, share, or distribute using the App

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Service

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, or in courts of competent jurisdiction if arbitration is not applicable.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and End-User License Agreement, constitute the entire agreement between you and Nicholas Benoit regarding your use of the App and supersede all prior agreements and understandings.
