End-User License Agreement (EULA)

1. License Grant

Nicholas Benoit ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Snag It ("the App") on devices that you own or control, strictly in accordance with this EULA and the App's documentation.

This license does not grant you any rights to use the Licensor's trademarks, logos, or other intellectual property beyond what is necessary to use the App as intended.

2. License Restrictions

You agree NOT to:

• Copy, modify, or distribute the App or any portion of it
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Rent, lease, lend, sell, sublicense, or transfer the App to any third party
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any unlawful purpose or in violation of any applicable laws
• Use the App to infringe on the intellectual property rights of others
• Bypass, disable, or interfere with any security features of the App
• Use automated systems or software to extract data from the App

3. Ownership and Intellectual Property

The App is licensed, not sold. Nicholas Benoit retains all right, title, and interest in and to the App, including all intellectual property rights therein. This EULA does not convey any ownership interest in the App.

All content downloaded through the App belongs to its respective copyright owners. You acknowledge that downloading content does not transfer any ownership rights to you beyond what is permitted by the original content creator and applicable law.

4. Third-Party Services

The App utilizes third-party services to provide certain features:

• RevenueCat: For subscription and purchase management
• Google AdMob: For displaying advertisements (free tier)
• Apple App Store / Google Play: For payment processing

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

5. User-Generated Content

The App allows you to download media content from third-party platforms. You are solely responsible for:

• Ensuring you have the right to download and use such content
• Complying with the terms of service of the source platforms
• Respecting copyright and intellectual property rights
• Any consequences arising from your use of downloaded content

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NICHOLAS BENOIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF RESULTS

We do not warrant that the App will meet your requirements, operate without interruption, or be error-free. Download functionality depends on third-party platforms which may change or become unavailable at any time.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NICHOLAS BENOIT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THIS EULA OR YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP OR ANY SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless Nicholas Benoit from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the App
• Your violation of this EULA
• Your violation of any rights of any third party
• Any content you download, store, or distribute using the App

9. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms.

Upon termination, you must cease all use of the App and delete all copies from your devices. Termination will not limit any of our other rights or remedies at law or in equity.

Sections relating to Ownership, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law shall survive termination.

10. Updates and Modifications

Nicholas Benoit may from time to time develop and provide App updates, which may include upgrades, bug fixes, patches, and other modifications ("Updates"). Updates may also modify or delete features or functionality.

You agree that Nicholas Benoit has no obligation to provide Updates or to continue to provide or enable any particular features or functionality.

We reserve the right to modify this EULA at any time. Your continued use of the App after any modifications indicates your acceptance of the modified EULA.

11. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce, and trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control.

12. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the United States, without giving effect to any principles of conflicts of law.

Any legal action or proceeding relating to this EULA shall be brought exclusively in the federal or state courts located in the United States, and you consent to the jurisdiction of such courts.

13. Severability

If any provision of this EULA is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Nicholas Benoit with respect to the App and supersedes all prior or contemporaneous understandings regarding such subject matter.

15. Waiver

No failure or delay by Nicholas Benoit in exercising any right, power, or privilege under this EULA shall operate as a waiver thereof, nor shall any single or partial exercise preclude any other or further exercise of any right, power, or privilege.
